Bell Circuit Court hands out sentences

PINEVILLE — The Bell County Circuit Court recently handed out several sentencings. Individuals and their charges are compiled in the list below, as follows:

Walter Mullins, Jr., 33, of Arjay was found guilty on charges of disorderly conduct, a Class B misdemeanor, second degree fleeing or evading police, a Class A misdemeanor, resisting arrest, a Class A misdemeanor, third degree possession of a controlled substance, first offense, a Class A misdemeanor, second degree possession of a controlled substance, first offense, a Class A misdemeanor, possession of marijuana, a Class A misdemeanor, and use or possession of drug paraphernalia, first offense, a Class A misdemeanor. Mullins was sentenced to serve 90 days in the Bell County Jail and will be required to pay court costs in the amount of $151 within 180 days of release. He will receive credit for 16 days time served.

Wesley George Upton, 31, of Pineville was found guilty on charges of second degree wanton endangerment, a Class A misdemeanor, and first degree fleeing or evading police, a Class D felony. Upton was sentenced to serve five years in a state penitentiary designated by the Department of Corrections and twelve months in the Bell County Jail. The sentences will run concurrently with each other. He will also be required to pay court costs in the amount of $151 within 180 days of release.

Ruby Darlene McCoy, 45, of Middlesboro was found guilty on charges of unlawful possession of methamphetamine precursor, first offense, a Class D felony, first degree possession of a controlled substance, first offense, a Class D felony, and use or possession of drug paraphernalia, first offense, a Class A misdemeanor. McCoy was sentenced to serve five years in a state penitentiary, but will actually serve 60 days in the Bell County Jail. She will be placed on supervised probation for a period of five years under specific terms and conditions. McCoy will also be required to pay court costs in the amount of $151 within 180 days of release.

Donald Franklin Woolum, 79, of Middlesboro was found guilty on charges of trafficking in a controlled substance in or near school, a Class D felony, and second degree trafficking in a controlled substance, first offense, a Class D felony. Woolum was sentenced to serve two years in a state penitentiary designated by the Department of Corrections. He will be required to pay court costs in the amount of $131 within 180 days of release.

Timothy Wayne Houston, 23, of Middlesboro was found guilty on charges of first degree wanton endangerment, a Class D felony, third degree assault, a Class D felony, first degree fleeing or evading police, a Class D felony, and resisting arrest, a Class A misdemeanor. Houston was sentenced to serve four years in a state penitentiary designated by the Department of Corrections and twelve months in the Bell County Jail. The sentences will run concurrently with each other. He will be required to pay court costs in the amount of $151 within 180 days of release.

Eddie Lynn Adams, 52, of Middlesboro was found guilty of operating a motor vehicle while under the influence, first offense (with aggravating circumstances), a Class B misdemeanor, and second degree fleeing or evading police, a Class A misdemeanor. Adams was sentenced to serve one year in the Bell County Jail, but will actually serve four days in the Bell County Jail. He will be placed on supervised probation for a period of 24 months under specific terms and conditions, and will be required to pay court costs in the amount of $151 within 180 days of release. His driving privilege will also be suspended for a period of 180 days.

Claude Anthony Taber, 41, of Lexington, Ky., was found guilty of operating a motor vehicle while under the influence, third offense, a Class A misdemeanor, and first degree fleeing or evading police, a Class D felony. Taber was sentenced to serve five years in a state penitentiary designated by the Department of Corrections and twelve months in the Bell County Jail. Taber will be required to pay a fine of $500 and court costs in the amount of $151, both within 180 days of release. He will also be required to pay restitution in the amount of $800 on behalf of the victim David LaFoe. His driving privilege will be suspended for a period of two years, and he will receive credit for 189 days time served.
