Bell County Circuit Court hands down sentences

PINEVILLE — The Bell County Circuit Court recently handed down several sentencings.

Gary Michael Lucas, 40, of Tazewell, Tenn., was found guilty of the charges of operating a motor vehicle while under the influence, fourth offense, a Class D felony, operating a motor vehicle on revoked/suspended license, first offense, a Class B misdemeanor, possession of marijuana, a Class A misdemeanor, and possession of drug paraphernalia, first offense, a Class A misdemeanor. Lucas was sentenced to serve five years in a state penitentiary designated by the Department of Corrections, and then an additional thirteen months in the Bell County Jail. He will be placed on unsupervised probation for a period of five years under specific terms and conditions, and will be required to pay court costs in the amount of $151 within 180 days of release. His driving privilege will also be suspended for a period of five years.

Charles R. Bussell, 30, of Manchester, Ky., was found guilty of the charges of operating a motor vehicle while under the influence, first offense, a Class B misdemeanor, second degree fleeing or evading police, a Class A misdemeanor, third degree assault, a Class D felony, and persistent felony offender in the second degree, a Class C felony. Bussell was sentenced to serve eleven years in a state penitentiary designated by the Department of Corrections. He will be required to pay court costs in the amount of $151 within 180 days of release, and will receive credit for eight days time served.

Maggie A. Poppe, 23, of Middlesboro was found guilty of trafficking in a controlled substance in or near a school, a Class D felony. Poppe was sentenced to serve three years in a state penitentiary designated by the Department of Corrections, and will be required to pay court costs in the amount of $131 within 180 days of release. She will receive credit for seven days time served.

Thelma D. Partin, 64, of Middlesboro was found guilty of an amended charge of first degree possession of a controlled substance, first offense, a Class D felony. Partin was sentenced to serve five years in a state penitentiary, which shall be probated, and she will be placed on supervised probation for a period of five years under specific terms and conditions. She will be required to pay court costs in the amount of $151 within 180 days.

Stanley Ray Davis, 33, of Middlesboro was found guilty of the charges of second degree possession of a controlled substance, first offense, a Class A misdemeanor, and possession of drug paraphernalia, first offense, a Class A misdemeanor. Davis was sentenced to serve 45 days in the Bell County Jail, and will be required to pay court costs in the amount of $151 within 180 days of release. He will receive credit for two days time served.

Crystal Gail Smith, 31, of Middlesboro was found guilty of second degree trafficking in a controlled substance, first offense, a Class D felony. Smith was sentenced to serve one year in a state penitentiary designated by the Department of Corrections, and will be required to pay court costs in the amount of $151 within 180 days of release. She will receive credit for 18 days time served.

Jason Dwayne Lambdin, 29, of Woodbine, Ky., was found guilty of an amended charge of third degree criminal possession of a forged instrument, a Class A misdemeanor. Lambdin was sentenced to serve one year in the Bell County Jail. He will be required to pay court costs in the amount of $151 within 180 days of release, and restitution in the amount of $150 on behalf of the victim, Jerry Richard Ledford. He will receive credit for 96 days time served.
