Bell County man indicted for allegedly running over woman with car

PINEVILLE — Jason Henry Partin, 35, of Pineville was recently indicted by a Bell County Grand Jury for assault in the first degree. Partin’s indictment alleges that on or about May 30, 2003, he displayed extreme indifference to the value of human life by wantonly engaging in conduct which created a grave risk of death to Shari Miller. Partin allegedly knocked Miller to the ground and ran over her with his car, thereby causing serious physical injury to Shari Miller.

Bell County Circuit Court issued the following indictments, in addition to Partin’s:

Dawn Marie Roe, 28, of Middlesboro was indicted for operating on a suspended or revoked license, and receiving stolen property over $10,000. Roe’s indictment alleges that on or about August 28, 2009, she was found to be operating a motor vehicle while her driver’s license was suspended or revoked. The indictment states that “at the same place and time, Roe received, retained, or disposed of a 2007 Toyota Camry from Gambrel Toyota — with a value of more than $10,000 — without the permission of Gambrel Toyota and with intent to deprive.”

Jeffery Hollingsworth, 42, of Pineville was indicted for second degree trafficking in a controlled substance, first offense. Hollingsworth’s indictment alleges that on or about March 25, 2009, he knowingly and unlawfully sold Hydrocodone, a Schedule III controlled substance, as a first offense.

Malinda Lawson, 38, of Arjay was indicted for second degree trafficking in a controlled substance, first offense. Lawson’s indictment alleges that on or about March 30, 2009, she knowingly and unlawfully sold Hydrocodone, a Schedule III controlled substance, as a first offense.

Donnie Ray Rutherford, 36, of Middlesboro was indicted for the theft of identity of another without consent. Rutherford’s indictment alleges that on or about May 21, 2009, he knowingly used the name, social security number and date of birth of his brother, Charles Rutherford, without his consent, for the purpose of avoiding detection.

Cora D. Kyle, 41, of Middlesboro was indicted for second degree trafficking in a controlled substance (first offense) and second degree persistent felony offender. Kyle’s indictment alleges that on or about July 14, 2009, she knowingly and unlawfully sold Hydrocodone, a Schedule III narcotic, as a first offense. At the same place and time, Kyle being more than 21 years of age had been convicted of one prior felony.

Robert Kemper Owen, 37, of Tazewell, Tenn., was indicted for operating a motor vehicle while under the influence (first offense), operating on a suspended or revoked license, two counts of first degree possession of a controlled substance (first offense), and third degree possession of a controlled substance (first offense). Owen’s indictment alleges that on or about July 15, 2009, he was found to be operating a motor vehicle while under the influence, and with a suspended/revoked driver’s license. At the same and place, he knowingly and unlawfully possessed Morphine, a Schedule II narcotic, and Oxycodone, a Schedule II narcotic. He was also found to be in possession of Buprenorphine, a Schedule III narcotic, as a first offense.

An indictment is a formal charge or a written accusation of a crime. Those indicted are presumed innocent unless proven guilty in a court of law.
