ROSE HILL, Va. — A Rose Hill man has been charged in the shooting death of a 22-year-old home health worker, according to law enforcement.

Charles James Givens, 40, was arrested Thursday afternoon and charged with first degree murder after he turned himself in for shooting Misty Leann Garrett of Jonesville, Va. at his residence in Rose Hill, according to the Lee County Sheriff’s Office.

According to Sheriff Gary Parsons, Garrett was employed by Innovative Home Health Care of Big Stone Gap, Va., and doing a home health visit at Given’s mother’s residence on Blue Hollow Road, where he also lived.

Garrett was sitting next to Given’s mother in her home when Givens snuck up behind the chair she was sitting in and fired a .22 caliber rifle into the top of Garrett’s head, according to Parsons who cites evidence at the scene and statements made by Givens.

Kim Lane, a representative from Innovative Home Health Care, made a statement regarding the situation.

“We wish our condolences to the family,” said Lane. “She was a very good nurse.”

Lane said Garrett had worked at the home health service for three years but could not go into more detail about this particular situation because of HIPAA laws which protect patient confidentiality.

When asked if this incident would change their protocol for making home visits, Lane said that it would not because they weren’t at fault.

Parsons said that Givens called dispatch after he shot Garrett and told police what had happened.

Givens later told investigators that he had asked Garrett to be his girlfriend and that she had refused. Givens further stated to police he had been planning the murder “for some time.”

Givens is being held at the Duffield Regional Jail without bond. He will be arraigned in Lee County General District Court on Monday morning.

This is absolutely awful and it just makes me wonder what would cause a human being to do that to another person. This is a perfect exmaple of how crazy people are now. This man is ruthless and should be punished severly.
