The Lee County Sheriff’s Office reports that they arrested a man they believe to have robbed the 421 Market in Stone Creek, which occurred on July 7, 2009.
Sheriff Gary Parsons said the man is accused of entering the market, masked from head-to-toe, brandishing a sawed off shotgun. He then took the cash register and fled in a small black car.
Parsons said an eyewitness followed the vehicle and saw it pull on to Jackson Road just north of the market. When police went to that location, they found the smashed cash register and the clothes the clerk identified as those worn by the assailant.
According to Parsons, the items were sent to the Virginia State Forensics Laboratory for testing. A DNA profile search was done against Virginia’s DNA Data Bank. A match was found to be consistent with 29-year-old Jacob Edward Burgan of Closplint, Ky.
Burgan was arrested in Harlan Co. and was charged with armed robbery, according to Parsons. He is being held without bond awaiting extradition back to Lee Co.
An arrest is an accusation only. Those arrested are considered innocent unless proven guilty in a court of law.
