LONDON (AP) — A relative of two men charged in a federal hate crime case has testified that the two alleged attackers laughed about assaulting the victim and said they did it because the man is gay.
The Lexington Herald-Leader reported that 18-year-old Alex Jenkins testified Tuesday in London after spending a night in jail for refusing to testify against his brother, 20-year-old Anthony Ray Jenkins, and cousin, 37-year-old David Jason Jenkins. Prosecutors say the trial is the first of its kind under a law passed in 2009.
Prosecutors say they beat 29-year-old Kevin Pennington at Kingdom Come State Park in Harlan County in April 2011 because of his sexual orientation.
Under cross-examination, Alex Jenkins acknowledged telling multiple accounts of what the two men said but insisted jurors were hearing the truth.
