Woman sentenced for stealing from Belk’s

The woman accused of stealing money from Belk’s was sentenced in Bell Circuit Court on Monday. Joy Lynn Beaupry, 62 of Middlesboro, was sentenced to five years on the charge of theft by deception over $500 but less than $10,000. If the sentence is probated, she will be placed on supervised probation for five years.

According to the original indictment, Beaupry was indicted on theft by deception over $10,000. The charge was eventually reduced. Beaupry unlawfully took cash from the deposits before taking the deposits to the bank.

Jonathan D. Smith, of Middlesboro, was also formally sentenced in circuit court on Monday. He was originally indicted on the charges of criminal attempt to commit theft by unlawful taking under $500, four counts of complicity to commit theft by unlawful taking under $500, complicity to commit first-degree criminal mischief and second-degree unlawful transaction with a minor.

Smith was sentenced to 90 days in the Bell County Jail on the four complicity charges and the criminal attempt to commit theft charge. He was sentenced to five years for the charges of complicity to commit criminal mischief and unlawful transaction with a minor charge. If the five year sentences are probated, Smith will be placed on supervised probation.

Other sentences handed down in circuit court include:

* Joseph D. Levi, 28 of Pineville, was sentenced on three different indictments. On the first, he was sentenced to one year in the penitentiary on the charge of receiving stolen property under $10,000. On the second and third indictment, Levi was sentenced to ten years in the penitentiary on the charge of second-degree burglary;

* Donald D. Sharp, 40 of Pineville, was sentenced to five years in the penitentiary on the charge of assault under extreme emotional distress. Sharp will actually serve six months in the Bell County Jail. If the sentence is probated, he will be placed on supervised probation for five years.
