Jackie Brian Overbay, 26, of Middlesboro, was indicted on one count of first-degree robbery for allegedly threatening the use of physical force while armed with a handgun in the course of committing a theft.
Overbay was arrested for the crime after attempting to flee the scene of the robbery on foot. A bystander pursued Overbay and observed him enter a red Ford Mustang.
The driver and a passenger in the Mustang were later released after it was determined that they had no knowledge of Overbay's alleged intent to rob Highway Oil.
In an unrelated case David L. Price, 21, of Middlesboro, was indicted for driving a motor vehicle under the influence (fourth offense), failure to illuminate head lamps, no insurance (first offense), driving on a revoked license and expired registration plates.
A Harlan County woman was also indicted by the grand jury.
Chastity C. Blevins, 29, of Coldiron, was indicted for second-degree criminal possession of forged instrument, tampering with physical evidence and first-degree being a persistent felony offender.
In a separate indictment, Kenneth Eugene Saylor, also of Coldiron, was indicted for receiving stolen property (over $300).
According to the indictment, Saylor allegedly received, retained or disposed of a P-38 9mm pistol, a black leather P-38 holster and a 41 Blackhawk revolver valued at more than $300 knowing the guns and holster was stolen from William North.
