Det. Bill Davidson described toddler's blue eyes as piercing. Those eyes, which opened for the first time in 2003, closed for the final time in late April.

Bryson Tyler Gilbert died April 20 from severe head and abdominal injuries.

His mother's live-in boyfriend, Ryan Tyler Baker, 25, of Speedwell, Tenn., faces charges of first-degree murder stemming from the death.

According to the sworn affidavit, Gilbert was rushed to St. Mary's Hospital in LaFollette on April 19, hospital personnel immediately had the child airlifted to East Tennessee Children's Hospital where he arrived in an unresponsive state.

Gilbert died the next day.

At the hospital it was noted that the blond-haired toddler had a severe brain injury and impact bruising to the ears an multiple abdominal bruises.

According to the affidavit, Sarah Gilbert, the baby's mother, said she left her son alone with Baker at approximately 6:05 a.m. on April 19. She said she has checked Bryson Gilbert prior to leaving and he was fine until he was fed at approximately 12:45 p.m.

Baker stated in the affidavit that while the child was eating spaghetti, he left the room briefly and heard a "thump." Bakers said he returned to find that Bryson Gilbert had fallen off the couch and was choking.

He said he attempted to resuscitate the toddler.

Medical personnel at East Tennessee Children's Hospital and the forensic pathologist who conducted the autopsy said the child's injuries are not consistent with Baker's story.

According to information gathered by Dr. Dirinka Milusnec, a pathologist at the University of Tennessee Medical Center, the autopsy revealed bruising to Bryson Gilbert's head, hand, chest, abdomen and crotch area. An internal investigation of the child's head revealed scalp hemorrhages. An internal investigation of the abdomen revealed blood clots, a bruised and lacerated liver and a torn duodenum (the upper portion of the small intestine.)

Milusnec's report indicated that the child could have died either from the head trauma or the abdominal injuries.

Baker was arrested on May 11 by Detectives from the Claiborne County Sheriff's Department, he was lodged in the Claiborne County jail and is currently being held on a $1 million bond.
