True Bill No. 12780: James Douglas Smith was indicted on one count of DUI'- second offense (TCA 55-10-401 - A Misd), one count of driving on a revoked DL (TCA 55-50-504 - A Misd), and on count of violation of implied consent (TCA 55-10-406 - A Misd). The charges are the results of Smith's actions on December 3, 2004 when he did unlawfully operate a motor vehicle upon and over a public road in Claiborne County while its operator's license had been revoked and did unlawfully and knowingly refuse to submit to a test for the purpose of determining the alcohol or drug content of his blood after being placed under arrest for DUI and being properly advised of the consequences of refusing to do so.

True Bill No. 12781: Richard Warf was indicted on one count of child abuse and neglect (under 6) (TCA 39-15-401 - D Felony), one count of simple possession of schedule II (TCA 39-17-418-- A Misd), one count of simple possession of marijuana (TCA 39-17-425-- A Misd), one count of possession of drug paraphernalia (TCA 39-17-425 - A Misd), and one count of public intoxication (TCA 39-17-310 - C Misd). These charges are the results of Warf's actions on July 18, 2004 when he did unlawfully, feloniously, knowingly and other than by accidental means, treat a child under six years of age in such a manner as to inflict injury or did neglect said child so as to adversely affect the child's health and welfare, unlawfully and knowingly possess a schedule II controlled substance, to-wit: cocaine, unlawfully and knowingly possess a schedule VI controlled substance, marijuana, unlawfully possess drug paraphernalia with the intent to use same to contain, or introduce into the human body a controlled substance, and unlawfully appear in a public place under the influence of an intoxicating substance to the degree that said Warf may have been endangered or other persons or property may have been endangered.

True Bill No. 12782: Brad Bernard was indicted on one count of DUI (TCA 55-10-401 - A Misd). The charge is the result of Bernard's actions on November 19, 2004 when he did unlawfully drive or be in physical control of a motor driven vehicle on a public road, street, or highway or a premises which is generally frequented by the public at large while the alcohol concentration in said defendant's blood or breath is eight-hundredths of one percent or more.

True Bill No. 12783: Brandon K. Branham was indicted on one charge of resisting stop, frisk, halt, arrest, search (TCA 39-16-602 - B Misd), one count disorderly conduct (TCA 39-17-305 - C Misd), and one count of public intoxication (TCA 39-17-310 - C Misd). These charges are results of Branham's actions on September 26, 2004 when he did unlawfully and intentionally prevent or obstruct a known law enforcement officer from effecting a stop, frisk, halt, arrest, or search by using force against the law enforcement officer, unlawfully engage in violent and threatening behavior in a public place and with the intent to cause public annoyance or alarm, and unlawfully appear in a public place under the influence of an intoxicating substance to the degree that said Branham may have been endangered or other persons may have been endangered.

True Bill No. 12784: James Edward Gibson was indicted on one count of driving on revoked DL (TCA 55-50-504 - B Misd) and one count of possession of burglary tools (TCA 39-14-701 - A Misd).

The charges are the result of Gibson's actions on June 20, 2004 when he did unlawfully operate a motor vehicle upon and over a public road in Claiborne County while his operators license had been revoked and unlawfully possess a tool, machine, or implement with intent to use the same, or allow the same to be used to commit burglary.

True Bill No. 12785: Christy M. Overbay was indicted on one count of DUI - second offense (TCA 55-10-401 - A Misd).

The charge is a result of Overbay's actions on October 24, 2005 when she did unlawfully drive or be in physical control of a motor vehicle on a public road, street, or highway or a premises which is generally frequented by the public at large while under the influence of an intoxicant, marijuana, narcotic drug, or drug producing stimulating effect on the central nervous system, which at the time of aforesaid offense, she had been previously convicted of DUI on or about March 25, 2004 in Bell County, Kentucky.

True Bill No. 12786: Jeff E. Gambrel was indicted on one count of DUI (TCA 55-10-401 - A Misd) and one count of violation implied consent (TCA 55-10-406 - A Misd). The charges are the results of Gambrel's actions on November 6, 2004 when he did unlawfully drive or be in physical control of a motor driven vehicle on a public road, street, or highway or a premises which is generally frequented by the public at large while under the influence of an intoxicant, marijuana, narcotic drug, or drug producing stimulating effects on the central nervous system and unlawfully and knowingly refuse to submit to a test for the purpose of determining the alcohol or drug content of his blood after being placed under arrest for DUI and being properly advised of the consequences of refusing to do so.

True Bill No. 12787: Isaac Lee Oakes was indicted on one count of DUI (TCA 55-10-401 - A Misd) and one count of possessing a handgun while under the influence (TCA 39-17-1321-- A Misd).

These charges were incurred on December 4, 2004, when Oakes did unlawfully drive or be in physical control of a motor driven vehicle on a public road, street, or highway or a premises which is generally frequented by the public at large while the alcohol concentration in said defendant's blood or breath is eight-hundredths of one percent or more and unlawfully and knowingly possess a handgun while under the influence of alcohol or any controlled substance.
