Staff Report

The safety subcommittee plans to deed land over to one Middlesboro resident during the next Middlesboro City Council meeting. The safety committee met on Thursday to discuss the property, which is located on 46th street along West Cumberland Avenue.

The property, which is owned by Eunice Dunn, is located directly in front of a railroad. The home was placed in front of the railroad during the 1960s. The issue at hand involves the location of the house.

The railroad has a 30 foot of right-of-way, which extends to the edge of Dunn’s house. There is also a sewer, water and electric easement located in the same area.

To correct the problem, the city plans to deed the grassy area behind Dunn’s house for her to use. The deed will state that Dunn will not be able to build a permanent structure on the property. The city will still possess the right-of-way for utility purposes. There will be no alley closed in the process.

The move will also waive liability from the city in the case of an accident on the property. The council will vote on the item at the next city council meeting.
