Bell Co. Circuit Court hands down sentences

PINEVILLE — The Bell County Circuit Court recently handed down several sentencings.

Michael Burchfield, 43, of Middlesboro was found guilty of fraudulent use of a credit card over $100 within a six month period, a Class D Felony. Burchfield was sentenced to serve five years in a state penitentiary, but will actually serve 90 days in the Bell County Jail. He will be required to pay court costs in the amount of $151 within 180 days, as well as restitution in the amount of $1,360 on behalf of the victims, Meredith Evans and Community Trust Bank of Middlesboro. He will also be placed on supervised probation for a period of five years under specific terms and conditions.

Sue Brock, 39, of Middlesboro was found guilty of fraudulent use of a credit card over $100 within a six month period, a Class D Felony. Brock was sentenced to serve five years in a state penitentiary, which will be probated, and she will be placed on supervised probation for a period of five years under specific terms and conditions. She will be required to pay court costs in the amount of $151 within 180 days, as well as restitution in the amount of $1,360 on behalf of the victims, Meredith Evans and Community Trust Bank of Middlesboro.

Pordnijah M. Flanary, 20, of Middlesboro was found guilty of two amended charges of second degree possession of a controlled substance, each a Class A Misdemeanor. Flanary was sentenced to serve 90 days in the Bell County Jail, and will be required to pay court costs in the amount of $151 within 180 days. She will receive credit for 15 days time served in jail.

Tracy Lynn Napier, 34, of Harlan was found guilty of the charges of third degree possession of a controlled substance, a Class A Misdemeanor; operating a motor vehicle while under the influence, fourth or greater offense, a Class D Felony; operating a motor vehicle while license is revoked/suspended, first offense, a Class A Misdemeanor; and first degree possession of a controlled substance, a Class D felony. Napier was sentenced to serve two years at a place designated by the Department of Corrections, and an additional 12 months in the Bell County Jail. She will be required to pay court costs in the amount of $131 within 180 days of release, and will receive credit for three days time served in jail.

Lauren Lynn Ferrell, 25, of London, Ky., was found guilty of the charges of operating a motor vehicle while under the influence, less than 21 years of age, a Class B Misdemeanor; operating a motor vehicle while license is revoked/suspended, second offense, a Class A Misdemeanor; and giving an officer false name or address, a Class B Misdemeanor. Ferrell was sentenced to serve 90 days in the Bell County Jail, and will be required to pay court costs in the amount of $151 within 180 days of release. She will receive credit for 77 days time served in jail.

Donovan C. Pena, 32, of Manchester, Ky., was found guilty of first degree trafficking in a controlled substance, first offense, a Class C Felony. Pena was sentenced to serve ten years in a state penitentiary designated by the Department of Corrections. He will be required to pay court costs in the amount of $151 within 180 days of release, and will receive credit for 19 days served in jail.

Brian Edward Eldridge, 32, of Baxter was found guilty of the charges of first degree possession of a controlled substance, first offense, a Class D Felony; possession of drug paraphernalia, second or greater offense, a Class D Felony; and operating a motor vehicle while under the influence, first offense, a Class B Misdemeanor. Eldridge was sentenced to serve four years in a state penitentiary designated by the Department of Corrections, and an additional 30 days in the Bell County Jail. He will be required to pay court costs in the amount of $151 within 180 days of release, and will receive credit for two days served in jail. His driving privilege will also be suspended for a period of 90 days.
