HB 42 introduced for all agencies

State Rep. Rick Nelson introduced a broadened version of House Bill 144 last month in an attempt to help any agency who deals with Medicaid managed care organizations.

The bill states that if any breach of a contract occurs or has occurred between any agency, department or cabinet of the Commonwealth, then services to the Medicaid members served under the contract shall immediately cease and members shall be transitioned to a Medicaid fee-for-service program.

The bill also states that any provider of services who is due funds as a result of a contract between a Medicaid managed care organization and the Commonwealth shall still be able to recover them.

This bill would allow any agency to break their contract with managed care organizations if a breach of contract takes place. The bill has been introduced to both the House of Representatives and Health and Welfare Committee.

House Bill 144 was recently introduced to the House and Health and Welfare Committee. HB 144 was a narrow version of HB 42 and targeted only school clinics.
